The house justice committee approved the bill restoring the death penalty by a 12-6 vote with one abstention.
Restoring the death penalty for heinous crimes like illegal drug selling was one of the campaign promises of President Rodrigo Duterte.
Now these are the crimes punishable by death in the death penalty bill.
- Piracy in general and mutiny on the high seas or in Philippine waters
- Qualified piracy
- Qualified bribery
- Parricide
- Murder
- Infanticide
- Rape
- Kidnapping and serious illegal detention
- Robbery with violence against or intimidation of persons
- Destructive arson
- Plunder
- Importation of dangerous drugs and/or controlled precursors and essential chemicals
- Sale, trading, administration, dispensation, delivery, distribution and transportation of dangerous drugs and/or controlled precursor and essential chemicals
- Maintenance of a den, dive or resort where any dangerous drug is used or sold in any form
- Manufacture of dangerous drugs and/or controlled precursors and essential chemicals
- Possession of dangerous drugs
- Cultivation or culture of plants classified as dangerous drugs or are sources thereof
- Unlawful prescription of dangerous drugs
- Criminal liability of a public officer or employee for misappropriation, misapplication or failure to account for the confiscated, seized and/or surrendered dangerous drugs, plant sources of dangerous drugs, controlled precursors and essential chemicals, instruments/ paraphernalia and/or laboratory equipment including the proceeds or properties obtained from the unlawful act committed.
- Criminal liability for planting evidence
- Carnapping
The bill proposes any of the following methods in carrying out the sentence: hanging, firing squad or lethal injection.
Majority Leader Rodolfo Farinas, a co-author of the bill said that death penalty is better than extrajudicial killing because the criminal would be given a chance to defend his case.
“What do we want EJK (extra judicial killing) or JK (judicial killing)? At least ‘yung judicial killing may (the judicial killing goes through) due process,” Farinas said.
Despite of the groups including the Roman Catholic Church who strongly opposed the death penalty, the house was determined to pass it before Christmas.
